How do I make a complaint about the response to my claim? 

Learn what support is available to help you with making a complaint.  

If your complaint is about how the Sensitive Claims team has handled a part of your claim, you can make a complaint to them.

You can make a complaint about the response to your records request by email, phone, or post 

Contact the MoE Sensitive Claims team by:

The types of issues you could complain about include: 

  • you have not heard from the Ministry of Education 20 working days after you requested your records
  • your copy of the records seems to have too much information redacted (learn about redacted information). 

You can also make a complaint to the Privacy Commissioner or the Ombudsman    

The Privacy Commissioner and Ombudsman may only investigate complaints if you have already tried making a complaint to the Ministry of Education. 

You can also get legal advice and support if you want to make a complaint. 

The Privacy Commissioner

The Privacy Commissioner deals with complaints about your rights to access and correct your personal information.  

For example, you can complain to the Privacy Commissioner if you are unhappy with the Ministry of Education's response to your complaint about redacting the wrong information from your copy of records about you.

The Office of the Ombudsman

The Ombudsman deals with complaints about government agencies.  For example, you could complain to the Ombudsman if you are unhappy with the Ministry of Education's response to your complaint about:

  • them continuing to call your phone number, after you asked them to email you instead
  • not providing you with the information you requested
  • their decision not to give you access to records about a deceased whānau member.
